About These Terms
These Terms and Conditions govern your use of The Tea Collective website (theteacollective.com.au) and the purchase of products through our online store, physical locations and any other channels operated by The Tea Collective (ABN 21 604 170 765), a business registered in New South Wales, Australia.
By accessing our website or placing an order you agree to these terms. Please read them carefully before purchasing.
Our Products
All products are subject to availability. We reserve the right to discontinue any product at any time without notice. Product images are for illustrative purposes only and may vary slightly from the actual product.
We take great care to ensure product descriptions and ingredients are accurate. However we recommend that customers with allergies or dietary requirements review all ingredient information carefully before purchasing. If you are unsure please contact us at hello@theteacollective.com.au before placing your order.
Pricing
All prices are displayed in Australian dollars (AUD). Our teas and other GST-free food products are not subject to GST. Where GST applies — teaware, candles, bath soaks, tea wine and other non-food items — it is calculated and shown at checkout.
We reserve the right to change prices at any time without notice. The prices that apply to your purchase are those in effect at the time your order is confirmed.
Orders & Payment
By placing an order you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Payment must be made in full at the time of purchase, unless payment terms have been agreed in writing for a wholesale account. We accept all major credit cards, PayPal, Shop Pay and other payment methods as displayed at checkout.
Order confirmation does not guarantee availability. In the unlikely event that a product becomes unavailable after your order is placed we will contact you promptly to arrange a refund or suitable alternative.
Gift Cards
Gift cards are available for purchase online and in store. The following conditions apply:
- Gift cards are valid for 3 years from the date of purchase
- Gift cards cannot be redeemed for cash
- Gift cards cannot be returned or refunded
- Lost or stolen gift cards cannot be replaced
- Gift cards can be used in conjunction with other offers unless otherwise stated
- Remaining balances on gift cards are not redeemable for cash
- Physical gift cards are available in store only
- Digital gift cards are available online and can be used in store or online
Subscriptions
We offer subscription services for select products. By subscribing you agree to the following:
- Your subscription will automatically renew at the frequency you select at the time of sign up
- Payment will be charged automatically to your nominated payment method at each renewal
- You may pause, reschedule or cancel your subscription at any time through your account portal
- Subscriptions can be cancelled at any time, provided the order has not already been packaged or shipped. Once an order has entered the fulfilment process it cannot be cancelled and our standard Refund & Returns Policy will apply.
- Cancellations must be made before your next scheduled renewal date to avoid being charged for that period
- Where a subscription has been paid for in advance, that payment is non-refundable. See our Cancellation Policy.
- We reserve the right to modify subscription pricing with reasonable notice provided to subscribers
- Subscription products are subject to availability
Bundles & Discounts
The offers described in this section are available to retail customers only and do not apply to wholesale orders.
- Discounts apply to qualifying items only as specified at the time of the offer
- Bundle discounts cannot be combined with other promotional codes unless otherwise stated
- Free gifts are available while stocks last and are subject to availability
- We reserve the right to modify or withdraw bundle offers at any time without notice
- Sitewide spend thresholds for free gifts are calculated on the order subtotal after any discounts have been applied
Wholesale & Stockists
Who this applies to
This section applies to businesses purchasing from The Tea Collective for resale, through an approved wholesale account. Where this section conflicts with any other part of these Terms, this section applies to wholesale orders. Wholesale enquiries can be directed to sales@theteacollective.com.au.
Account approval
Wholesale accounts are opened at our discretion. We may request an ABN, business details and information about your premises before approving an account, and we may decline or close an account at any time. Accounts are for the business named on the account and may not be transferred.
Minimum orders
A minimum order value of $150 applies to your first wholesale order. Reorders have no minimum order value. Individual products carry minimum quantities and order multiples, which are shown on each product page.
Pricing
Wholesale prices are shown once you are logged in to your account. Our teas and other GST-free food products are not subject to GST. Where GST applies it is calculated and shown at checkout.
We may change wholesale pricing at any time, and will give reasonable notice of material changes. The price that applies is the price at the time your order is confirmed.
Retail promotions, discount codes, bundle offers and free gift thresholds advertised on our website apply to retail customers only and cannot be used on wholesale orders.
Recommended retail price
We publish a recommended retail price for each product as a guide, to help you position our range. It is a recommendation only. You are free to set your own retail prices, and nothing in these terms requires you to sell at or above any particular price.
Payment
Your first wholesale order is always paid in full at the time of ordering.
After that, orders are also paid in full at the time of ordering, unless payment terms have been agreed for your account in writing. Terms are never implied or assumed — if we haven’t confirmed them in writing, they don’t apply. Where terms are in place, invoices are due within the agreed period from the invoice date, and overdue accounts may be placed on hold and further orders declined until the balance is settled.
Delivery
Wholesale orders ship at a minimum freight charge of $30. Where the courier’s calculated cost is higher than that, the calculated cost applies and is shown at checkout, based on the size, weight and destination of your order.
If a freight charge appears to have calculated incorrectly, we’ll contact you with the correct cost before dispatch so you can decide whether to go ahead with the order.
Please keep your delivery address, business hours and any access instructions current. Costs arising from failed delivery, redirection or return to sender are passed on at cost, as set out in our Shipping Policy.
Damaged or short deliveries
Please check your order on arrival and let us know within 3 business days of delivery of any damage, shortage or discrepancy, with photographs where relevant. We will credit confirmed shortages and transit damage. Change-of-mind returns are not accepted on wholesale orders. Nothing in this clause limits your rights under the Australian Consumer Law.
Cancellations
Wholesale orders can be cancelled or amended until they enter our fulfilment process. Once packed, an order cannot be cancelled.
Storage and handling
Our teas are food products. Stockists agree to store products in a cool, dry place away from direct sunlight and strong odours, to observe best-before dates, and not to repack, decant, relabel or alter our products or packaging in any way before resale.
Where you may sell
You’re welcome to sell our products through your own physical store and your own online store.
Selling through third-party marketplaces — such as Amazon, eBay or Catch — needs our written agreement first. It’s not that we want to make life difficult; those channels affect how the brand is presented and priced for everyone stocking us, so we like to talk it through. If you’re considering a channel and aren’t sure whether it counts, just ask and we’ll let you know.
Use of our brand
We grant approved stockists a non-exclusive, revocable licence to use our product photography, product descriptions and logo for the purpose of promoting and selling our products, in their original unaltered form. This licence ends when your account ends. You may not register or use our name, or anything confusingly similar, as a business name, domain name or social media handle.
Exclusivity
Wholesale accounts are non-exclusive. We may supply other businesses in your area and sell directly to consumers through our own website and stores.
Ending an account
Either of us may close a wholesale account at any time by notice in writing. Orders already accepted will be fulfilled. Closing an account does not affect any amount already owing.
Intellectual Property
All content on The Tea Collective website including but not limited to text, photography, graphics, logos, brand assets, tea blend names, recipes and product descriptions is the intellectual property of The Tea Collective and is protected by Australian and international copyright law.
You may not reproduce, distribute, modify, publish or use any of our content for commercial purposes without our prior written consent. Unauthorised use of our intellectual property may result in legal action.
User Conduct
When using our website you agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorised access to any part of our website or systems
- Transmit any harmful, offensive or disruptive content
- Reproduce or misuse any of our intellectual property
Limitation of Liability
To the maximum extent permitted by Australian law, The Tea Collective is not liable for any indirect, incidental, special or consequential loss or damage arising from the use of our products or website. Our liability is limited to the value of the products purchased.
Nothing in these terms limits your rights under the Australian Consumer Law.
Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our website after changes are posted constitutes acceptance of the updated terms.
